3. Legal Basis for Processing
Personal data is processed under GDPR Article 6(1)(b) — processing necessary for the performance of a contract or pre-contractual measures — and Article 6(1)(f) — legitimate interest in responding to business inquiries.

4. Data Retention
Contact form submissions are retained for a maximum of 24 months from the date of submission. Contract-related data is retained for the duration of the contractual relationship plus 6 years in compliance with Spanish commercial record-keeping obligations.

5. Data Recipients
Personal data is not transferred to third parties unless required by law, necessary for the performance of a contract (e.g., payment processors), or with explicit consent. All third-party processors are bound by Data Processing Agreements per GDPR Article 28.

6. International Transfers
ZenithFusionLab does not transfer personal data outside the European Economic Area unless adequate safeguards are in place, including Standard Contractual Clauses approved by the European Commission.

7. Data Subject Rights

Refund Policy

1. Service Delivery
ZenithFusionLab delivers web development, design, and consulting services as defined in individual project proposals and statements of work. All services are performed with reasonable skill and care in accordance with industry standards.

2. Project Milestones
Projects are structured around defined milestones with corresponding payment schedules. Upon completion and client approval of each milestone, the associated payment becomes non-refundable as the work has been delivered and accepted.

3. Cancellation Before Work Commences
If a project is cancelled before any work has commenced, a full refund of any advance payment will be issued within 14 business days. Cancellation must be communicated in writing to [email protected].

4. Partial Refunds
If a project is cancelled mid-development, partial refunds may be issued at the sole discretion of ZenithFusionLab based on the proportion of work completed versus the total project scope. Work already delivered and accepted is non-refundable.

5. Defective Delivery
If delivered work materially fails to meet the specifications agreed upon in the project proposal, ZenithFusionLab will, at its option: (a) remedy the defects within a reasonable timeframe, or (b) issue a partial refund proportional to the defective portion of the work.

6. Non-Refundable Items
The following are non-refundable: third-party licenses or software purchased on behalf of the client, domain registration fees, hosting setup fees, and consulting hours already rendered.

7. Dispute Resolution
Refund disputes shall first be addressed through direct communication. If unresolved, disputes shall be submitted to the jurisdiction of the courts of Madrid, Spain, in accordance with applicable Spanish consumer protection law.

Terms of Service

1. Acceptance of Terms
By accessing the website and services of ZenithFusionLab, located at Calle Puerto de las Pilas 18, Planta Baja A, Madrid, Spain, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.

2. Scope of Services
ZenithFusionLab provides web application development, UI/UX design, infrastructure consulting, and related technical services. The specific scope, deliverables, timelines, and pricing for each project are defined in individual proposals and statements of work accepted by the client.

3. Intellectual Property
Upon full payment, all custom code, designs, and documentation created specifically for the client under a project agreement are assigned to the client. ZenithFusionLab retains ownership of pre-existing tools, libraries, frameworks, and general methodologies used in the delivery process.

4. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the course of a project. This obligation survives the termination of the business relationship for a period of 36 months.

5. Limitation of Liability
ZenithFusionLab's total liability under any project agreement shall not exceed the total fees paid by the client for the specific project giving rise to the claim. ZenithFusionLab shall not be liable for indirect, consequential, or incidental damages.

6. Payment Terms
Invoices are payable within 14 days of issuance unless otherwise specified in the project agreement. Late payments accrue interest at the rate of 2% per month, or the maximum rate permitted by law, whichever is lower.

7. Force Majeure
Neither party shall be liable for delays or failures in performance resulting from causes beyond reasonable control, including but not limited to acts of God, government actions, natural disasters, or internet infrastructure failures.

8. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Spain. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.

9. Modifications
ZenithFusionLab reserves the right to modify these Terms of Service at any time. Material changes will be communicated via email to active clients or through prominent notice on this website at least 30 days before taking effect.
